Does the 10 user limit apply to deactivated or deleted users?

IF you deactivate a user, does that mean one more user frees up in your limit of 10?

or do you have to delete?

Deactivated users are not counted towards the user limit. From https://confluence.atlassian.com/display/JIRA/Managing+Users#ManagingUsers-Deactivatingauser:

Will not count towards your JIRA user license limit. Refer to the JIRA Users global permission explanation on Managing Global Permissions for more information.
