Best practice for category NEW status

For some reason we have defined for our Jira the NEW status (very first status in the workflow) as "In Progress" Category, but we have lot of project members that disagree and should be rather "TO DO" (including me).  Although seems obvious that depends of the project context, is there any documented best practice or discussion about which category should be used or not with the "NEW" status?

You can find examples of several statuses for the initial status. I don't believe you'll find a 'best practice'. The default workflow is Open.  You can have different initial statuses for different issue types if they have different workflows.
