i have restricted the user to not create a ticket for a particular project, in the permission level. Even though he can able to access and create a ticket.

You could use the Filter number (just pick up the # from the URL when you are on your filter).
Then simply do your query based on the Filter # like so :
Where 10200 would be the filter # and this will return the results of your filter.
This solution does not work with "Filter Results" macro. It does work though with JIRA issue/filter macro.
