how is it possible that when creating a task from mail (email handler), the person who created this

I'm not sure about your Jira, but we have quite a few different "resolutions", one of which is Won't fix. We use this for issues which are rejected. So you would move it to the Resolved status and choose a resolution other than Fixed or Done
