We have a JIra server license expired on 12/04/2021 04:00 and we are trying to upgrade from 8.14.0 to 8.16.0 released on 23/03/2021 according to

So the version is covered by our license but we can not update anyway?
"Your current Jira Software license doesn't allow you to upgrade to this version of JIRA (8.16.0). Jira Software expired on 12/04/2021 04:00, and you can currently only upgrade to versions released prior to this date."
Downgrade to 8.15.0 fails with the same message.
Downgrade to 8.14.0 fails entirely with failed plugin report.

I understand that you are having a problem with trying to upgrade Jira due to an expired license. I tried to lookup your account, but I did not find any licenses on your account here. I only found expired evaluation licenses which I would not expect to work here.
Do you happen to have an SEN number for this license? How to find my SEN for more info. I would be interested to learn more about the specific applied license here. I agree that you should be able to perform this upgrade if that date is correct, but there can be complicating factors here. For example, if you have an expired license for Jira core or Jira Service Management applied to this same Jira instance, then this can still prevent you from upgrading Jira Software even if that license should permit it. Which means we really need to understand all of the Jira product licenses that are currently applied here.
If you have access to the SQL database of Jira you can follow the steps in Manage Jira server license using database queries to see exactly which Jira product licenses are currently applied there. For Jira 7.0.5 and higher versions you can just use a query such as
SELECT * FROM productlicense;
to see all the licenses currently applied.
Try that and let me know the results. I can obscure or redact any sensitive license information if need be here.

I would take this up directly with Atlassian support. I doubt there is much we can do here at the community as the license seems to block it.
You can raise a ticket with them thru https://support.atlassian.com/contact
i'll also notify them of this question here in case your expired license no longer allows you to raise a ticket.
