My jira server license is expiring soon and the migration to jira data centre is planned one month after the server license expires (due to complications).
If a security patch arrives in the period we are unlicensed and not migrated yet, will the patch/update be available for an unlicensed jira server version?
Also will the configured automation rules still work after the license of that app expires?

unfortunately you can't upgrade a JIRA instance without an active license.

Upgrades and patches are not the same thing. You will not be able to upgrade, but a patch is a direct injection of fixed code that does not change the version of your system.
However, Atlassian very very rarely use patches, it's only done with critical faults or where a client cannot upgrade for reasons other than licence-expired.
