When I try to create or edit a filter it does not let me Switch to Basic even though there is nothing in the query.
And, if i hover over the Switch to Basic it says The query is to complex to display in Simple mode.

If creating custom select Build custom count from the drop-down. The custom counts are set using JQL - so for example to create an Overdue count...
Which means that you can't use "Switch to basic" because you need to provide your JQL query.

Also I just put a filter count gadget on the system dashboard and was able to use Basic filter so there has to be a way to change it.

Ok, so here is what i just discovered. If you use a Project instead of a saved filter you can use the Basic filter but if it is a saved filter you cannot. Apparently you cannot basic filter a filter

Because it is possible to switch to basic if you've got a simple query defined. It would be poor UX to have a button that gets (apparently) randomly hidden and shown according to what the user is doing.

Basic searches do not support "search for everything".
Try adding a simple query to it (like "Project = ABC") and you should be able to switch to basic.
