JQL Query on "Customer Request Type" does not seem to work correctly

The following JQL query does not seem to work correctly:

project = "Assimoco SERVICE DESK" AND status not in (Done, Closed) AND issuetype not in (Problem, "SubTask(S)") AND "Customer Request Type" is EMPTY

it returns, among others, issues in which the Request Type is defined.

What are we doing wrong?

And if you try this JQL what do you observe?

project = "Assimoco SERVICE DESK" AND "Customer Request Type" is EMPTY

i expect the same thing. However I am not experiencing this issue.

Odd. Do you have a lot of issues like this? It would be interesting to see if you cleared the value (none) and then reset would this scenario clear.
