Our client needs to know if they will be able to update the instance which is expirated to a version before that expiration date (Feb 15, 2024). We checked that according to your documentation (https://confluence.atlassian.com/jirakb/what-happens-when-a-jira-license-expires-1283361632.html#:~:text=When%20a%20Server%20license%20expires,released%20after%20the%20license%20expired) it's possible for Jira but we wonder if it's also viable for Confluence.

for my knowledge you can't upgrade Confluence to a new version even if the target tool version has been released before the license expiration date.
Approach you linked in your answer is valid for SERVER version and not for Data Center instances.

If you are on a server instance you should be able to do that. Test it on a testing env first ;)

Yes, the rule is "you can use any version released before the end of your licence"
