Avoid tasks being created within epics

is there a way to only allow tasks to be added into storys and not under epics?

Yes, when you're creating issues (story or task) in the backlog make sure you select all issues (rather than selecting an Epic). it will create the issue in the backlog without it being associated to an epic.
