Can we upgrade JIRA 6.1 to latest version (6.3.9) in eval licence?

There are few bugs in our current JIRA application which is under evaluation and are fixed in latest version so wanted to evaluate them and will proceed to buy licence for go-live.

So, are we good to upgrade JIRA in evaluation Licence ?
