Hi We are using JIRA Software and JSD server edition in same instance, due to some storage issue we are planning to migrate the server instance to AWS EC2

No, migrating to AWS is completely secure and there is no need to change the license - it is still a "server" Atlassian solution.
A license policy change would only be required if migrating to official Atlassian Cloud only.

You can move the database and the application and home directory to new server.
