Sourcetree is free for users and has no limitations, you simply need to sign in with an Atlassian account. It is not open source and has not been previously. Git is entirely independent project, not from Atlassian, and will be open source forever most likely.

Sourcetree presents you the customer agreement during setup to review before continuing. In the About dialog you'll find links to licenses for individual resources like Git, Mercurial, GitFlow AVH, Git-LFS, and more.
