We have two instance of JIRA one is v 5.0.1 and we need to merge it with v 5.2 can this be done without upgrading the 5.0.1 to 5.2 as that department let their license run out and will not be able to upgrade it. The consolidation is to the the meging of two departments into one.
You need to check that whether version 5.2 was released before your licence expired. If yes, then you can upgrade although you will not be eligible to receive any support from atlassian helpdesk.
you're allowed to upgrade to any version that is released before your license expires, regardless of when you actually happen to perform the upgrade.
Please also note that some people have experienced trouble with upgrading greenhopper beyond the maintainence period.

Unfortunately, this is not possible unless you upgrade.
It is mandatory that both versions must be on the same version (to the same build number) in order to progress with project import.
