Atlassian guarantees 99.90% uptime for Premium products and 99.95% uptime for Enterprise products.

We have had cases where Atlassian did not achieve their uptime target, and made a compensation claim. The process is quite smooth.
NOTE: Because this is a Monthly uptime target they won't finalize compensation until after the end of the calendar month of the outage.
