Cannot assign, apparently sub-tasks are also locked by service desk
What happens if the subtask is created via the JIRA UI?

getting a message that user cant be assigned, the user of course has permissions to do so. Problem is that service desk permission overrides these permissions. If i select a user that is a service desk agent all is well.

You should be able to as they are normal JIRA issues, not Service Desk tickets. Caveat: I have not tested this.
