JIRA Software and licenses

We're currently running JIRA 6.4.8 with JIRA Agile.  We are also upgrading our license limit to the next tier, and due to the emergence of JIRA Software do not need to buy a new license for JIRA Agile.  Do I need to upgrade to JIRA Software before I can move to the new license tier?
