We are about to build a new Confluence server and need it up and running with the old instance until the old instance is retired.
Do I need a new licence key for the new server?

In general you need a valid license for your production instance. You cannot have two production instances that are using one license. In your specific case you can always generate a developer license and use it on your old instance for example. (since this will be used for a reference, right?).
To generate a developer license you will need to go to your atlassian account (my.atlassian.com) and where you have your commercial license of JIRA there should be also a link to a developer license.
When new system will live just retire the old one and you will be fine.
